By accessing or using Everything Mermaid (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Nature of the Service

Everything Mermaid is provided as a free, experimental, and continuously evolving web-based tool. The Service may be modified, suspended, or permanently discontinued at any time, with or without notice.

There is no guarantee of availability, uptime, performance, or data retention.

2. No Warranties

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, either express or implied.

arising from or related to your use or inability to use the Service, even if advised of the possibility of such damages. You acknowledge that you are solely responsible for maintaining backups of any diagrams or content you create.

4. Assumption of Risk

You assume full responsibility for any risks associated with using the Service, including but not limited to:

• data loss
• unauthorized access
• service outages
• software bugs
• security vulnerabilities

5. User Content

You retain ownership of any Mermaid code, diagrams, titles, and descriptions you create (“User Content”).

You grant Ever Evolving Software, LLC a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service.

Ever Evolving Software, LLC does not access your User Content unless required for technical troubleshooting or explicitly requested by you via email.

6. Acceptable Use

You agree not to use the Service:

• for illegal purposes
• to infringe on intellectual property rights
• to distribute malicious code
• to harass, abuse, or harm others
• to attempt unauthorized access to systems

You are solely responsible for any content you create or share.

7. No Data Guarantee

Ever Evolving Software, LLC does not guarantee the long-term availability, persistence, or recoverability of your data. You are solely responsible for exporting and backing up your content.

8. Termination

Ever Evolving Software, LLC reserves the right to suspend or terminate access to the Service at any time, for any reason, without notice.

9. Changes to Terms

Ever Evolving Software, LLC may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which Ever Evolving Software, LLC is organized, without regard to conflict-of-law principles.
